Terms of Service

Words by the Hearth helps you turn memories, feelings, and occasions into a starting draft. The Service may include writing prompts, generated text, saved creations, sharing features, downloads, and related support.

We may add, remove, or change features, formats, or parts of the Service from time to time. A change to a feature does not change the words you own in your saved creations, subject to these Terms and any rights held by others.

You must be 18 years of age or older to create an account or purchase through the Service. By creating an account or purchasing, you represent that you meet this requirement.

You agree to provide accurate information and keep it current. You are responsible for activity under your account, for protecting your sign-in credentials, and for telling us promptly if you believe your account has been used without permission.

You retain the rights you have in the text, memories, names, and other material you submit to the Service. You are responsible for making sure you have the right to provide that material and use it for your requested purpose.

When you submit material, you give us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, and process it as reasonably necessary to operate, secure, maintain, and improve the Service and provide the features you request. This license ends for material when it is deleted, except where retention is reasonably necessary for security, legal compliance, dispute resolution, or the completion of a transaction.

Do not submit information that you do not want processed by the Service. Avoid unnecessary sensitive personal information, including financial account numbers, passwords, government identification numbers, or another person’s private information.

The Service may use automated and artificial-intelligence tools to suggest or generate text. Generated content is a creative starting point, not a promise of truth, originality, accuracy, or suitability for your particular situation.

You are responsible for reading, editing, and approving anything before you use, share, print, or rely on it. The output may contain mistakes, unintended similarities, incomplete context, or language that does not sound like you.

Words by the Hearth is not a law firm, medical provider, mental-health provider, financial adviser, or emergency service. Do not use generated content as professional advice or as a substitute for qualified help, and do not rely on it in an emergency or safety-critical situation.

You may use the Service only in a lawful, respectful way and in accordance with these Terms. You must not use it to create, request, store, or distribute content or conduct that puts people at risk or interferes with the Service.

• violate a law, regulation, court order, or another person’s rights;
• facilitate violence, abuse, exploitation, harassment, threats, fraud, or other harm;
• sexualize or exploit minors, or request sexual content involving a minor;
• expose private information, impersonate someone, or create deceptive content intended to cause harm;
• probe, scan, reverse engineer, overload, disrupt, or bypass the security or safety systems of the Service;
• scrape the Service, create accounts abusively, or use automated means to access it except as we expressly permit; or
• infringe copyright, trademark, privacy, publicity, or other rights belonging to another person or organization.

• We may refuse, limit, remove, or review requests and content when reasonably necessary to enforce these restrictions, protect people, protect the Service, or comply with law.

When checkout is enabled, the Service offers two purchase options for an eligible saved creation. Standard is $4.99 and includes the personalized digital creation. Keepsake is $9.99 and includes the personalized digital creation plus a premium printable PDF. Payment availability depends on the operator’s billing setup and is indicated in checkout.

Prices are shown in U.S. dollars unless stated otherwise. The total presented at checkout is the amount we ask you to authorize, subject to any taxes or other charges disclosed before payment. Payment is processed through the hosted checkout provider shown during checkout.

We may change prices or purchase options for future purchases. The price displayed when you submit your purchase is the price for that transaction.

After a payment is confirmed, digital creations are made available through the account and writing desk associated with the purchase. Keepsake purchases include access to a premium printable PDF through My keepsakes. You are responsible for downloading and safely storing copies you wish to keep.

If a paid creation or included PDF does not arrive or cannot be accessed, contact us at wordsbythehearth@polsia.app with the email used at checkout and the relevant purchase details. We will work with you to restore access, provide a replacement where reasonably possible, or address the issue as required by applicable law.

Because purchased creations are digital goods made available for download, purchases are generally final once delivery or access is provided, except where a refund is required by law or we agree to one. If you believe there was a payment error, failed delivery, duplicate charge, or another problem with your purchase, contact us promptly so we can review it.

Subject to payment and these Terms, we grant you a non-exclusive, non-transferable license to access, download, print, privately share, and use the purchased creation for your personal, non-commercial purposes. You may give a copy to the person or people for whom it was created.

You may not resell, license, publish as a paid product, mass-distribute, or commercially exploit a purchased creation, or represent Words by the Hearth’s service, templates, or brand as your own. This license does not give you rights to the Service itself or to third-party material that may appear in or alongside a creation.

The Service, including its software, design, names, logos, visual elements, prompts, templates, documentation, and underlying technology, is owned by or licensed to Cairn & Crown The House of Bowen LLC and is protected by intellectual-property and other laws. Except for the limited rights expressly granted in these Terms, we reserve all rights in the Service.

If you send us suggestions or feedback, you allow us to use it without restriction or payment to you, provided we do not identify you publicly as the source without your permission.

We handle account information, submitted material, purchase details, and support messages to operate the Service, provide requested features, maintain security, and meet legal obligations. Payment card details are handled by the hosted payment provider rather than stored directly by Words by the Hearth.

For questions about information associated with your account, saved creations, or a support request, contact wordsbythehearth@polsia.app. We will respond according to the information and rights available under applicable law.

The Service may rely on third parties for hosting, authentication, payment processing, artificial-intelligence processing, email delivery, analytics, or other infrastructure. Those providers may have their own terms and privacy practices, and their services may be subject to separate outages or limitations.

We are not responsible for third-party services that we do not control. Your use of a third-party service may be governed by your agreement with that provider. We do not ask you to send full card numbers or security codes through our help form.

We work to keep Words by the Hearth available and useful, but the Service may be unavailable, delayed, interrupted, or changed because of maintenance, updates, network conditions, provider outages, security events, or circumstances outside our reasonable control.

When you contact support, provide enough information for us to understand the issue without sending passwords, full payment-card details, or other unnecessary sensitive information.

To the fullest extent permitted by law, the Service and all content made available through it are provided on an “as is” and “as available” basis. We disclaim warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.

You choose whether and how to use generated text. We do not promise that a creation will meet your expectations, be unique, be factually correct, be legally safe to use, or be appropriate for a particular audience or occasion. Some rights cannot be disclaimed in certain jurisdictions, so these disclaimers apply only to the extent permitted by law.

To the fullest extent permitted by law, Cairn & Crown The House of Bowen LLC and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from or related to the Service or these Terms.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us for the Service during the twelve months before the event giving rise to the claim or one hundred U.S. dollars. This limit does not apply where applicable law does not allow the limitation.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Cairn & Crown The House of Bowen LLC and its owners, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your submissions, your use or misuse of the Service, your violation of these Terms, or your violation of another person’s rights.

You may stop using the Service and request account closure by contacting us. You may delete saved creations through the features we provide, subject to limited retention that may be necessary for security, legal compliance, or transaction records.

We may suspend or terminate access to the Service, remove content, or refuse future use if we reasonably believe it is necessary to protect people or the Service, address misuse, comply with law, or enforce these Terms. Where appropriate and practical, we will try to provide notice.

Terms that by their nature should continue after access ends will survive termination, including provisions concerning purchases, licenses, intellectual property, disclaimers, liability, indemnification, governing law, and electronic communications.

These Terms and your use of the Service are governed by the laws of the State of Alaska, without regard to conflict-of-law rules. Subject to any rights you may have under applicable law, disputes relating to these Terms or the Service will be brought in the state or federal courts located in Alaska, and you consent to their jurisdiction and venue.

When you use the Service, create an account, or contact us electronically, you consent to receive communications from us electronically, including account notices, transaction messages, service updates, and responses to support requests. Electronic communications satisfy any legal requirement that communications be in writing, except where applicable law requires a different form.
